“Yasai App” Terms of Service for End Users

Agreeing to and consenting to these Terms by a Registered User is a prerequisite for the Registered User to use this Service, and in the event that a Registered User violates any part of these Terms, the Registered User may be refused further use of this Service without prior notice. In addition, if the registered user is a minor (under 18 years old) or other person with limited capacity to act, please be sure to obtain the consent of a legal representative (guardian, person with parental authority, etc.) before agreeing to and consenting to these Terms.

This service provides a place for transactions in which contracted farmers and registered users enter into agricultural product purchase and sale contracts, and registered users directly harvest the agricultural products in the field. Our company does not conduct these transactions ourselves and is not entrusted with such transactions.

1. The purpose of these Terms is to define the terms of provision of the Service and the relationship of rights and obligations between the Company and Registered Users regarding the use of the Service, and applies to all relationships between Registered Users and the Company regarding the use of the Service.
2. Regarding this service, the descriptions on this site above, as well as the various regulations and rules presented through related websites, also form part of these Terms. Furthermore, in the event that the content of these Terms of Use differs from the content of related regulations, etc., the provisions of these Terms of Use shall take precedence.
3. If the content of these Terms differs from the rules in the preceding paragraph or other explanations of the Service outside of these Terms, the provisions of these Terms shall take precedence.

5. “Contract Farmer” refers to a person who registers with this Service and sells agricultural products to registered users through this Service, such as by direct harvesting.

Neni 3 (Regjistrimi)

1. Those who wish to use this Service (hereinafter simply referred to as "Applicants") may register to use this Service by agreeing to comply with these Terms and providing certain information specified by the Company in the manner specified by the Company. At this time, the person wishing to use the service must provide accurate and official information and apply for user registration.
2. Registration for use of this service is considered complete when notification of completion of use registration reaches the person wishing to use the service. From this point on, Registered Users may use the Service in accordance with these Terms.
3. Our company may refuse registration, re-registration, or cancel registration if a registration applicant falls under any of the following items, and we are not obligated to disclose the reason.

   2. If the person is a minor, an adult ward, a person under curatorship, or a person under assistance, and the consent, etc. of the legal representative, guardian, curator, or assistant has not been obtained.

4. If there are any changes to the registered information, the Registered User shall notify the Company of such changes without delay using the method specified by the Company. 1. In order to use this service, an online environment may be required to connect with our company and the operating servers contracted by our company. Registered users are responsible for installing and configuring equipment necessary for the online environment and connection, constructing a communication environment, and paying expenses.
2. Other than as specified in these Terms, the Company will not refund fees already paid by registered users due to non-use or inability to use the Service, such as non-use or inability to connect to the online environment.

Neni 5 (Management of password and user ID)

1. Registered users shall appropriately manage and store passwords and user IDs related to this service at their own responsibility, and shall not allow third parties to use them, nor may they lend, transfer, change name, buy or sell, etc.
2. Registered users are responsible for any damage caused by insufficient management of passwords or user IDs, errors in use, use by third parties, etc., and the Company assumes no responsibility unless there is intentionality or gross negligence.

Neni 6 (Service usage fee and payment method)

1. Registered users will not incur any fees when registering and starting to use this service, except for the fees stipulated in Neni 4 (Usage of the Internet).
2. Notwithstanding the preceding paragraph, when Registered Users purchase agricultural products using the method specified by the Company, they shall pay the price for the agricultural products to the Company or a third party designated by the Company. Please note that the payment for agricultural products is assumed to be made by the farmer receiving the payment through our company (so-called collection agency).

Neni 7 (Purchase, direct harvest, etc. of agricultural products)

1. Registered users can purchase agricultural products from contract farmers that are available for purchase by completing the prescribed procedures on this service. Registered Users must collect the purchased agricultural products directly from the fields of the contracted farmers within the time specified on the Service.
2. When a Registered User is asked for proof of agricultural products purchased from a contracted farmer, the Registered User shall prove the fact of purchase to the farmer using the purchase completion screen on the Service or the purchase notification email sent from the Service.
3. When using this service, Registered Users may enter the fields of registered farmers or direct sales offices, etc. only for the purpose of directly harvesting purchased agricultural products, etc., and must be careful not to damage the equipment, etc. of the fields or direct sales offices, etc.
4. If the Company determines based on reasonable grounds that the use of this Service violates these Terms or other terms and rules notified by the Company in connection with the Service, or is inappropriate, the Company shall 3 In addition to the measures stipulated in Neni 1, we may cancel the purchase activities of registered users at our discretion. Neni 8 (Transaction establishment and payment)

1. A sales contract for the agricultural products (hereinafter referred to as the "sales contract") shall be established when the purchaser purchases the agricultural products on this service. The seller and purchaser may not transfer, provide security for, or otherwise dispose of the rights and obligations arising under the sales contract to a third party.
2. If a sales contract is concluded, the purchaser shall pay for the agricultural products according to the method determined by the Company. 4. When using this service, cancellation after purchase is not possible. However, if the purchased agricultural products are not in the field or if there are defects such as rot, the contracted farmer will be responsible and will take measures such as refunds or replacements at the contracted farmer's responsibility and expense. In addition, in view of the nature of this service, in which crops are collected directly from the fields of contracted farmers, defects in crops are limited to those in which the condition of the crops has significantly deteriorated, such as rotting, so that they cannot be used as food ingredients, and does not include defects in shape, freshness, etc. that are below a certain level of quality.
5. The Company shall not be liable for any damage caused to the Registered User due to the payment method or financial institution information entered by the Registered User in the Service being used by a third party, the content of the input information being inaccurate, or the Company taking or not taking measures pursuant to this article, unless the damage is caused by the Company's intention or negligence.

Neni 9 (Cancellation of transaction and refund)

1. If the purchased agricultural products are not available in the field, or if there are defects such as rot, the Registered User may cancel the transaction in accordance with the procedures set forth in the Service.
2. Cancellation of a transaction will be initiated by a registered user or contracted farmer completing the procedure within this service only if it is approved within this service. In addition, details of various refund methods shall be in accordance with the provisions within this service.

When using this service, Registered Users must not engage in any acts that fall under any of the following items, or acts that the Company deems to fall under any of the following.

1. Acts that violate these terms and conditions and rules stipulated for the use of this service.
2. Acts that violate laws or are related to criminal acts
3. Fraud or threats against our company, other users of this service, or other third parties
4. Acts that violate public order and morals
5. Acts that infringe on the intellectual property rights, portrait rights, privacy rights, reputation, and other rights or interests of the Company, other users of the Service, or other third parties.
6. Through this service, send information that falls under, or that the company deems falls under, the following to the company or other users of the service.
   1. Information that contains excessively violent or cruel expressions
   2. Information that contains computer viruses or other harmful computer programs
   3. Information that includes expressions that damage the honor or credibility of our company, other users of this service, or other third parties.

   5. Information containing expressions that promote discrimination
   6. Information that includes expressions that encourage suicide or self-harm

16. Acts that violate the rules regarding the use of this service posted by our company on our website and other places
17. Acts aimed at meeting a stranger of the opposite sex
18. Acts that directly or indirectly cause or facilitate the acts listed in the preceding items.
19. Attempting any of the acts listed in the preceding items.
20. Other acts specified by our company or deemed inappropriate.

Neni 11 (Suspension of this service, etc.)

In the event that any of the following applies, the Company may suspend or suspend the provision of all or part of the Service without prior notice to registered users.

1. When urgently inspecting or maintaining computer systems related to this service
2. If the Service cannot be operated due to computer or communication line failure, incorrect operation, excessive concentration of access, unauthorized access, hacking, etc.
3. If the Service cannot be operated due to force majeure such as earthquake, lightning, fire, wind and flood damage, power outage, natural disaster, etc.
4. In other cases where the Company determines that suspension or interruption is necessary.

Neni 12 (Attribution of rights)

All intellectual property rights related to the Service belong to the Company or those who have licensed the Company, and the license to use the Service based on these Terms does not mean a license to use the intellectual property rights of the Company or the person who has granted the license to the Company regarding the Service.

Neni 13 (Registration cancellation, etc.)

1. If a Registered User falls under any of the following items, the Company may delete the Registered User's account, temporarily suspend the Registered User's use of the Service, or cancel the registration as a Registered User without prior notice or demand.

2. If any of the items in the preceding paragraph apply, the Registered User will naturally lose the benefit of time for any debts owed to the Company, and must immediately pay all debts to the Company.

Neni 14 (Withdrawal)

1. Registered Users may withdraw from the Service and cancel their registration as a Registered User by completing the procedures prescribed by the Company.
2. If the Registered User has any debts owed to the Company upon withdrawal, the Registered User will naturally lose the benefit of time for any debts owed to the Company, and must immediately pay all debts to the Company.
3. The handling of user information after withdrawal shall be in accordance with the provisions of Neni 18 (Handling of user information).

Neni 15 (Changes and termination of the content of this service)

1. Our company may change the content of this service at our convenience.
2. Our company may terminate the provision of this service with a notice period of 30 days after notifying the customer.
3. The notice or notice set forth in Paragraph 1 shall become effective immediately after the Company announces it on this site.
4. Notwithstanding the provisions of the preceding two paragraphs, if it becomes difficult to provide the Service due to reasons not attributable to the Company, the provision of the Service may be terminated by clarifying the reason for termination of the Service on this website immediately after the termination of the Service.
5. When the provision of this service is terminated, by following the procedures set forth in this article, the Company shall be exempted from any claims from the customer in connection with the termination of this service, except for matters stipulated by law.

Neni 16 (Disclaimer of warranty and liability)

The Company does not guarantee, expressly or implicitly, that the Service is suitable for the specific purpose of the Registered User, that it has the expected functionality, commercial value, accuracy, or usefulness, that the use of the Service by the Registered User complies with the laws and regulations applicable to the Registered User or the internal regulations of industry organizations, that it can be used continuously, or that there will be no defects.
2. The Company shall not be liable to compensate Registered Users for damages incurred in connection with this Service in excess of the amount of consideration paid by Registered Users through the use of this Service in the past 12 months, and shall not be responsible for compensating for incidental damages, indirect damages, special damages, future damages, or damages related to lost profits.
3. Any transactions, communications, disputes, etc. that occur between registered users and contracted farmers or third parties in connection with this service shall be resolved by registered users at their own responsibility.

Neni 17 (Confidentiality)

Registered Users shall treat non-public information disclosed by the Company to the Registered User in connection with this Service confidentially, unless prior written consent is obtained from the Company.

Neni 18 (Handling of user information)

1. The handling of user information of registered users by our company shall be in accordance with the separate provisions of our privacy policy, and registered users agree to our handling of user information of registered users in accordance with this privacy policy.
2. The Company may, at its discretion, use and publish the information, data, etc. provided by registered users to the Company as statistical information in a form that does not identify individuals, and registered users shall not object to this.
3. Notwithstanding the provisions of the preceding two paragraphs, if a registered user purchases agricultural products through Stripe, Stripe may You will be notified of the information you entered above. Registered users shall agree in advance to this notification act.
4. Agricultural product purchase and sale contracts in this service are between contracted farmers and registered users. Therefore, contract farmers are businesses that sell agricultural products and are obligated to make certain displays in accordance with the Specified Commercial Transactions Law. Therefore, when using this service, if a registered user encounters a problem such as not being provided with sold vegetables or not receiving a refund even though there is a legitimate reason for cancellation, the registered user will be required to display the contracted farmer's name, address, telephone number, etc. under the Specified Commercial Transactions Act. You may request that we provide you with the information you require.
5. In the event that a trouble arises between a contracted farmer and a registered user regarding the use of this service, and the registered farmer requests disclosure of the registered user's information, the Company may disclose the registered user's contact information and other information to the contracted farmer if the Company determines that the request is legally justified or reasonable.

Neni 19 (Changes to these Terms, etc.)

1. The Company may change these Terms as necessary, and such changes will become effective 24 hours after the Company posts them within the Service or notifies the User by electromagnetic means such as email, and the user will be deemed to have accepted the changes by using the Service for the first time thereafter. Please be aware of this and periodically check for notifications from this service.
2. If you do not agree to the changes in the preceding paragraph, please stop using this service immediately. Even in this case, we will not refund any expenses that have already been spent, and we will not respond to any claims for damages, etc., regardless of the name.

Neni 21 (Transfer of status under service usage contract, etc.)

1. Registered users may not assign, transfer, set collateral, or otherwise dispose of their status under the usage contract or the rights or obligations based on these Terms to a third party without the prior written consent of the Company.
2. In the event that the Company transfers the business related to this Service to another company, the Company may transfer the status under the usage contract, the rights and obligations based on these Terms, the registered information of Registered Users, and other customer information to the transferee of the business, and Registered Users shall agree to such transfer in advance in this section. Neni 22 (Severability)

Even if any provision or part of this Agreement is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of this Agreement and the remaining portions of the provisions that have been partially determined to be invalid or unenforceable shall remain in full force and effect.
